Title IX
Title IX of the Educational Amendments of 1972 ensures that no one in the U.S. can be discriminated against based on sex in any educational program receiving federal funds. South Arkansas College (SouthArk) adheres to this by prohibiting discrimination based on race, color, national origin, sex, disability, or age in its programs and employment. The college also protects its community from sexual harassment and misconduct, including sexual violence, domestic violence, dating violence, and stalking. What is Title IX?
SouthArk's policies on sex/gender harassment and misconduct are designed to protect the rights of individuals without limiting academic freedom or free speech. These policies allow for discussions on controversial or sensitive subjects within educational settings.
For campus resolution proceedings, SouthArk uses the "preponderance of the evidence" standard (also known as “more likely than not”), meaning a violation is determined if it's more likely than not. Legal terms such as guilt or innocence don't apply, and no assumption of violation is made. The proceedings consider all relevant evidence to ensure a fair resolution.
